Terms of Service
Last updated: 28/09/2026
These Terms of Service (the “Terms”) govern access to and use of CtrlCourt, an online booking and management software for padel clubs (the “Service”), published by DEVBOX (“we”, “us”, the “Publisher”).
1. Publisher

2. Purpose and professional use only
The Service allows a padel club to manage its courts, bookings, members, coaching, events and prepaid credits, and to offer its players an online booking space.
The Service is intended exclusively for professionals (companies, associations and other organisations operating a padel club) acting for the purposes of their business. It is not offered to consumers. By subscribing, you confirm that you are acting in a professional capacity.
In these Terms, the “Club” or “you” means the professional entity that creates an account, and “Players” means the end users (players, coaches, staff) whose accounts are created within the Club's space.
3. Acceptance
These Terms are accepted electronically when the Club's account is created, by ticking the corresponding box. The person who signs up declares that they are authorised to bind the Club. The Data Processing Agreement and the Privacy Policy form an integral part of these Terms. In the event of a conflict with any other document, these Terms prevail, except for matters relating to personal data, for which the Data Processing Agreement prevails.
4. Account and access
- The Club provides accurate and up-to-date information when signing up and keeps it up to date.
- The Club is responsible for the confidentiality of the credentials of its administrators and for all actions carried out from its account.
- The Club manages the roles (administrator, coach, player) it grants within its space and remains responsible for the use its users make of the Service.
- The Club must inform us without delay of any suspected unauthorised use of its account.
5. Free trial
Each new Club benefits from a free trial of 14 days, without any payment card being required. The trial gives access to the features of the Service, without any commitment.
At the end of the trial, if no subscription has been taken out, access to the administration area is limited to the subscription page and Players can no longer make bookings. The Club's data is kept, subject to Article 12, so that the Club can resume where it left off by subscribing.
6. Subscriptions, prices and payment
6.1 Plans and prices
The Service is offered under several plans (currently Starter, Pro and Business), billed monthly or annually. The prices and the content of each plan are those shown on our website and on the subscription page at the time of subscription. Prices are stated exclusive of tax; VAT or any other applicable tax is added in accordance with the rules in force, depending in particular on the Club's country and VAT number. The annual plan is billed at a reduced price equivalent to ten months.
6.2 Payment
Subscriptions are paid in advance, by bank card or any other method offered at checkout. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment is therefore collected and invoiced by Paddle, which applies and remits VAT or other applicable taxes. We never receive the Club's card details. Invoices are available in the billing portal.
6.3 Automatic renewal
Subscriptions renew automatically for periods identical to the one initially chosen (month or year), unless cancelled before the end of the current period. The card on file is charged at each renewal.
6.4 Change of plan
The Club may change plan at any time from its billing portal. The applicable terms (immediate effect, pro-rata adjustment or effect at the next renewal) are shown before the change is confirmed.
6.5 Price changes
We may change our prices. Any change applicable to an ongoing subscription is notified to the Club at least 30 days in advance and applies from the next renewal. The Club may cancel before that date if it does not accept the new price.
6.6 Cancellation
The Club may cancel its subscription at any time from its billing portal. Cancellation takes effect at the end of the period already paid; the Service remains accessible until then. Periods that have started are due and no pro-rata refund is made, subject to the guarantee described in our refund policy and to any mandatory legal provisions.
7. Payment failure
If a payment fails, the Club is notified and further payment attempts may be made. If the failure is not remedied within a reasonable time, we may, after notifying the Club, restrict access to the Service under the same conditions as at the end of the trial (Article 5) and then terminate the subscription. Amounts remaining due may bear late payment interest and, where applicable, the fixed recovery charges provided for by the applicable law.
8. Obligations of the Club
- Lawful use: the Club uses the Service in compliance with applicable laws and regulations, and does not use it for fraudulent, illicit or harmful purposes, nor attempt to disrupt it, access other clubs' data or circumvent its technical limits.
- Content: the Club is solely responsible for the content it publishes (name, logo, colours, texts, prices, events, etc.) and guarantees that it holds the necessary rights to it.
- Players' data: the Club is the controller of its Players' personal data. It is responsible for informing them, for having a legal basis for the processing and for responding to their requests, with our assistance as provided in the Data Processing Agreement.
- Relations with Players: bookings, prices, payments (cash, card at the counter, prepaid credits) and the rules of the club are a matter solely between the Club and its Players. When the Club enables online payment, Players pay into the Club's own Stripe account, which the Club opens and manages under its own responsibility; we do not collect any sums on behalf of the Club and are not a party to these relations.
9. Availability of the Service
We make every reasonable effort to keep the Service accessible and working properly, under an obligation of means (best efforts). No level of availability or response time is guaranteed. Access may be interrupted for maintenance, updates, security reasons or events beyond our control; where possible, planned maintenance is carried out at times of low activity. The Service is supplied “as is”; we may change its features, provided that the essential features of the subscribed plan are not substantially reduced.
10. Suspension
We may suspend all or part of the access to the Service, where possible after notice, in the event of a serious breach of these Terms, a payment failure (Article 7), use that endangers the security or operation of the Service, or at the request of a competent authority. The suspension is lifted once its cause has ended.
11. Intellectual property
The Service, its software, interfaces, texts, brands and logos are and remain our exclusive property or that of our licensors. The subscription grants the Club a personal, non-exclusive, non-transferable right to use the Service for the duration of the subscription, for its own needs. Any reproduction, decompilation or resale of the Service is prohibited, except as permitted by law.
The Club retains all rights to its data and content. It grants us a licence limited to what is strictly necessary to host and display them in order to provide the Service.
12. Data and reversibility
The Club remains the owner of the data entered in its space. Upon request sent to contact@ctrlcourt.com before the end of the subscription or within the retention period below, we provide an export of its main data (in particular members and bookings) in a standard format.
After the subscription ends, or after the end of a trial that has not been converted, the Club's data is kept for 30 days and then deleted, subject to data we are required to keep by law (in particular invoices) and backups, which are overwritten in their normal rotation cycle. We may extend this period for an inactive trial in order to allow the Club to resume; the Club may request earlier deletion at any time.
13. Liability
We are only liable for direct and foreseeable damage resulting from a breach of our obligations. We are not liable for indirect damage such as loss of revenue, loss of customers, loss of opportunity or damage to image, nor for damage resulting from the Club's use of the Service, content or data entered by the Club or its users, or from the Club's relations with its Players.
To the extent permitted by law, our total liability, all causes combined, is limited to the amounts actually paid by the Club over the twelve (12) months preceding the event giving rise to the liability. This limitation does not apply in case of gross negligence or wilful misconduct, or where the law does not allow it.
The Club remains responsible for keeping any copies of its data that it deems necessary, in particular by using the export available on request.
14. Force majeure
Neither party is liable for a failure caused by an event of force majeure within the meaning of the applicable law, including failures of networks or of hosting providers beyond its control.
15. Changes to these Terms
We may amend these Terms. Substantial changes are notified to the Club by email or in its administration area at least 30 days before they take effect. If the Club does not accept them, it may cancel its subscription before that date; continuing to use the Service after that date constitutes acceptance. Changes required by law or for security reasons may apply sooner.
16. Miscellaneous
If any clause of these Terms is held invalid, the other clauses remain in force. Our failure to invoke a clause does not constitute a waiver. The Club may not assign its subscription without our prior consent. In the event of translations, all language versions have the same value; in the event of divergence, the version in the language in which the contract was accepted prevails.
17. Governing law and jurisdiction
These Terms are governed by the laws of Tunisia. The parties will seek an amicable solution before any legal action. Failing this, any dispute relating to these Terms will be submitted to the exclusive jurisdiction of the courts of Tunis, including in the event of multiple defendants or third-party proceedings, subject to any mandatory rules of jurisdiction.
